The Supreme Court has granted anticipatory bail to Jaison Varghese in a Kerala case alleging criminal breach of trust, cheating and common intention.
Varghese joined the investigation following an earlier direction from the Court. The judges also recorded that a co-accused had already obtained bail.
Those two considerations—cooperation and parity—were sufficient to set aside the High Court’s refusal of pre-arrest protection. Varghese will remain bound by conditions imposed by the trial court.
The order does not evaluate the commercial or factual merits of the accusations. It instead limits the use of custody where the accused has complied with investigative requirements and comparable treatment has already been extended to another person in the same case.
