Jammu & Kashmir and Ladakh High Court

Retrospective Regularisation Claim Fails On Prior Proceedings And Distinct Selection History

The Jammu & Kashmir and Ladakh High Court dismissed a part-time sweeper's claim to retrospective regularisation and consequential benefits after he had already been regularised prospectively in 2013.

Judge / Bench — Justice Rajnesh Oswal

It found material suppression of earlier litigation concerning rejection of his claim and held that he could not pursue multiple petitions for the same relief. On merits, his proposed comparator had qualified the selection interview, while he had failed it; the respondents had also relied on the absence of a vacancy. Length of part-time service and a colleague's earlier appointment did not establish the claimed parity on these facts. The requested retrospective service and pension-related relief was not granted.
