Jammu & Kashmir and Ladakh High Court

FIR Is Not A Prerequisite For Preventive Detention — J&K High Court

The Jammu & Kashmir and Ladakh High Court upheld a Public Safety Act detention challenged principally because no FIR had been registered and the grounds were said to be vague.

Judge / Bench — Hon’ble Mr. Justice Rajnesh Oswal, Judge

Registration of an FIR is not a precondition to preventive detention, whose object differs from criminal punishment. On the record, the grounds identified alleged logistical assistance to a specified active terrorist and were considered sufficiently particular. The Court declined to substitute an appellate assessment for subjective satisfaction based on relevant material. Signed execution documents established supply of the relied-on material, and the record showed consideration and communication of the representations’ rejection. The petition was dismissed. The ruling turns on the specificity of the intelligence-based grounds and documented procedural compliance.
