J&K High Court Quashes Fresh PSA Detention Over Vague Reports And Representation Delay

A fresh Public Safety Act detention following an earlier quashed detention failed on several independent grounds.

Judge / Bench — Hon’ble Mr. Justice Rajnesh Oswal, Judge

The Jammu & Kashmir and Ladakh High Court found an unexplained interval of about twenty-five days between the sponsoring proposal and detention, undermining the asserted urgency in this case. The later patrol and beat reports were also vague and internally contradictory, leaving no adequate basis for the recorded satisfaction. Separately, the Government took nearly two months to decide the mother’s representation without explaining the delay. Applying the requirement of expeditious consideration, the Court quashed detention and directed immediate release unless the petitioner was required in another case. The decision does not prescribe a universal twenty-five-day cutoff; the unexplained delay and defective supporting material were central.
