Withdrawn Railway Policy Does Not Confer Vested Employment Rights On Land Losers — J&K High Court

Family members of railway land losers sought appointment under a policy withdrawn in 2019.

Judge / Bench — Hon’ble Mr. Justice Wasim Sadiq Nargal, Judge

The Jammu & Kashmir and Ladakh High Court held that acquisition of land, forwarding a nomination or pendency of representations did not establish an indefeasible employment right. The petitioners failed to show a vested entitlement or an applicable saving or transitional instruction protecting their claims after withdrawal; alleged parity and a list of cases under process were insufficient. The Court additionally emphasised that public employment must comply with Articles 14 and 16 and cannot be claimed through a mechanism bypassing open recruitment. The writ petition was dismissed. The decision granted neither appointment nor fresh consideration, and did not adjudicate an independent compensation claim for the acquired land.
