A dismissed bank officer relied on a later criminal acquittal to challenge his seventeen-year-old dismissal and seek service and retirement benefits.
Judge / Bench — Hon’ble Mr. Justice Rajnesh Oswal, Judge
The Jammu & Kashmir and Ladakh High Court rejected belated allegations of bias and procedural irregularity on delay, laches and acquiescence after his participation in the inquiry. It further held that criminal acquittal does not automatically invalidate disciplinary findings, given the different objects, evidence and standards of proof. On examining the acquittal, it found prosecutorial failures and non-production of material witnesses rather than an honourable exoneration undermining the departmental outcome. The writ petition was dismissed and interim protection ceased. A subsequent acquittal therefore did not, on these facts, revive a stale service challenge or establish consequential monetary entitlement.
