A Division Bench of the Jammu & Kashmir and Ladakh High Court set aside the Tribunal’s grant of retrospective out-of-turn promotion to Inspector from 1998.
Judge / Bench — Hon’ble Dr. Pushpendra Singh Bhati, Chief Justice, and Hon’ble Mr. Justice Wasim Sadiq Nargal, Judge; judgment by Wasim Sadiq Nargal:J.
An earlier recommendation did not itself create an enforceable right to promotion from that date; neither the service framework nor the earlier judicial directions established such entitlement. The Tribunal had relied on another officer’s treatment without addressing material factual differences, the prior rejection of Mir’s claim, or his prolonged inaction. Parity in exceptional promotions requires an independently established entitlement, and acquiescence must be examined through the claimant’s conduct and circumstances. The departmental rejection was restored, while Mir’s existing promotion from 29 September 2006 remained undisturbed. Counsel should establish the legal source and chronology of the claimed retrospective benefit, rather than rely on recommendation or analogy alone.
