Jammu & Kashmir and Ladakh High Court

Demarcation reassigned to avoid a familial conflict

The appellants challenged a writ order leaving their application for demarcation of land at Narkara to the Tehsildar, Budgam.

Judge / Bench — Hon’ble Dr. Pushpendra Singh Bhati, Chief Justice; Hon’ble Mr. Justice Rajesh Sekhri, Judge

They placed a supplementary affidavit before a Division Bench of the Jammu & Kashmir and Ladakh High Court stating that the officer was the son of private respondents 7 and 8, and requested another revenue authority. Government counsel did not oppose that request and assured a neutral exercise. Modifying the writ order, the Bench directed the Deputy Commissioner to assign the demarcation service to a competent authority other than the Tehsildar, Budgam, which must consider the matter and undertake demarcation under the applicable rules. The appeal was disposed of. The practical relief addresses an identified conflict in the administrative decision-maker; it determines neither title nor possession.
