Jammu & Kashmir and Ladakh High Court

J&K High Court Orders Final Bail Decision Within Two Weeks

The Jammu & Kashmir and Ladakh High Court on 9 October 2026 directed the Principal Sessions Judge, Kupwara, to decide a pending bail application finally within a fortnight.

Judge / Bench — Justice Yash Paul Bourney.

In Union Territory of Jammu & Kashmir v. Javid Ahmad Chad & Ors., CRM(M)826/2026, the UT sought cancellation of interim bail, alleging that the protection had not been extended but the accused remained at large.

The Court discouraged prolonged interim bail during trial because leaving the application undecided could impede the other side’s effective challenge. It permitted the UT to seek the trial court’s permission to take the accused into custody if their interim protection had not been extended. The High Court did not itself cancel bail or decide the accused’s entitlement to release.

Advocates appearing — Petitioner/UT — Mr Bikramdeep Singh, Dy. AG, with Mr Haaris Khan, Advocate. Respondents — Not named in the order.
