Jammu & Kashmir and Ladakh High Court

Undisclosed Pending Title Suit Defeats Parallel Writ Challenge To Stone-Crusher NOC

The Jammu & Kashmir and Ladakh High Court dismissed a co-sharer’s challenge to a stone-crusher NOC where the asserted ownership and possession rights were already contested in a pending civil suit with a status-quo order.

Judge / Bench — Hon’ble Mr. Justice Sanjay Parihar, Judge

Non-disclosure of that suit was material to discretionary writ relief. A later administrative certificate did not justify a parallel forum for resolving the same disputed proprietary foundation; evidence, amendment and appropriate interim applications belonged before the civil court. The Court also clarified that an administrative NOC neither conclusively establishes title nor defeats lawful proprietary rights. The petitioner retained lawful trial-court remedies, to be considered independently. For property-linked regulatory challenges, disclose existing litigation and identify a genuinely independent public-law issue before invoking writ jurisdiction.
