Jammu & Kashmir and Ladakh High Court

Further Investigation Into Terror Links Does Not Alone Make A Charge-Sheet Incomplete

The appellants sought default bail on the ground that a charge-sheet was incomplete because investigation into their alleged links with slain or absconding terrorists continued.

Judge / Bench — Justices Sanjeev Kumar and Yash Paul Bourney; judgment by Justice Yash Paul Bourney

Reviewing the charge-sheet and supporting material, the Division Bench found investigation complete regarding the offences made out against these accused. Continued inquiry into additional terrorist links and the possibility of a supplementary charge-sheet did not, on this record, establish an incomplete prosecution filing intended to defeat default bail. The Jammu & Kashmir and Ladakh High Court also found no basis to disturb refusal of bail on merits and dismissed the appeal, directing expeditious continuation of trial. The ruling concerns charge-sheet completeness on the evidence before the Court, not a general exemption from statutory investigation deadlines or a determination of guilt.
