The Jammu & Kashmir and Ladakh High Court dismissed a pending regular-bail request with liberty to move the trial court after being informed that the charge-sheet had been filed.
Judge / Bench — Hon’ble Ms. Justice Moksha Khajuria Kazmi, Judge
The earlier Sessions refusal had relied on section 37 NDPS restrictions and the then-incomplete investigation; a co-accused had already withdrawn a similar High Court request after the charge-sheet. The trial court was asked to consider a fresh application expeditiously according to law. The order does not hold that completion of investigation satisfies section 37 or entitles the applicant to bail. Its practical effect is to preserve a fresh request before the court now seized of the prosecution, with the substantive statutory tests and individual role still to be addressed.
