Expired Seasonal Engagement Advertisement Leaves No Effective Relief

Education Volunteers challenged a 2021 advertisement for six-month seasonal engagements, fearing replacement by fresh contractual workers.

Judge / Bench — Justice Moksha Khajuria Kazmi

The Jammu & Kashmir and Ladakh High Court noted that the advertisement expressly preferred existing volunteers and that no replacement pursuant to it was shown. By October 2026, the summer-2021 engagement period had long expired, leaving no effective relief against that advertisement. The three petitions were therefore dismissed as infructuous, with liberty to apply under any fresh advertisement subject to eligibility. The decision turns on expiry of the particular selection exercise and the factual absence of replacement. It does not grant continued engagement or regularisation, and the respondents’ broader submissions on temporary employment should not be mistaken for an independently adjudicated holding.
