Jammu & Kashmir and Ladakh High Court

Pending Policy Review Does Not Excuse Non-Consideration Under Operative SRO

The Jammu & Kashmir and Ladakh High Court held that the respondents had not complied with an earlier regularisation judgment merely by saying SRO 520 of 2017 was under review.

Judge / Bench — Hon’ble Mr. Justice Sanjay Dhar, Judge

No suspension, repeal or completed review was shown, and the writ judgment had already required consideration under the then-operative SRO. The respondents therefore had to undertake that exercise without treating the pending review as sufficient compliance. On disputed unpaid wages, they were also required to verify the muster rolls supplied by the workers and either release sums found due or give a consideration order explaining any finding of non-genuineness. A fresh compliance report was directed. The ruling enforces consideration and verification, rather than granting automatic regularisation or accepting every claimed wage amount.
