Jammu & Kashmir and Ladakh High Court

Higher Merit Supports Preferred Posting, While Transfer Representation Remains Open

A Division Bench of the Jammu & Kashmir and Ladakh High Court declined to interfere with rejection of a challenge to another ALC-category candidate’s appointment in Jammu.

Judge / Bench — Hon’ble Mr. Justice Sanjeev Kumar and Hon’ble Mr. Justice MA Chowdhary, Judges

The Tribunal’s examination showed that the selected comparator had substantially higher merit and received the posting on merit-cum-choice. The petitioner therefore could not displace that outcome merely through the competing location preference. The Bench nevertheless permitted a representation for feasible mutual transfer or adjustment against an available Jammu vacancy and required lawful consideration if submitted. It also observed that an administrative policy was needed for comparable inter-regional adjustments. The order preserves a route to request accommodation; it neither orders a transfer nor finds an enforceable right to a particular place of posting irrespective of comparative merit.
