Jammu & Kashmir and Ladakh High Court

Principal Employer Could Not Avoid Statutory Wage Liability Through Contractor Clauses

In the connected minimum-wage disputes, the Jammu & Kashmir and Ladakh High Court held that contractual responsibility for disbursing wages did not isolate the principal employer from statutory obligations; operational control, overtime deployment and AFCONS’s settlement of identical claims were material.

Judge / Bench — Justice Sanjay Parihar

The 2014 award was set aside and remanded because AFCONS was a necessary party but had not been heard before the authority. The 2017 award was modified to require AFCONS to satisfy it in full, relieving the agency of that liability. The ruling distinguishes immediate wage disbursement from ultimate financial incidence, and demonstrates why the principal employer must be impleaded and the contract read together with labour welfare legislation.
