Jammu & Kashmir and Ladakh High Court

Interim Challenge Withdrawn After Merger Into Final Appellate Order

A Division Bench of the Jammu & Kashmir and Ladakh High Court permitted withdrawal of the underlying supervisory petition after finding that the interim appellate order originally challenged had merged into a later final order.

Judge / Bench — Hon’ble Mr. Justice Sanjeev Kumar and Hon’ble Mr. Justice MA Chowdhary, Judges

The dispute arose from a Payment of Wages award; the pending High Court challenge no longer addressed the operative final appellate decision. Consequently, the underlying petition was dismissed as withdrawn and the Single Judge’s judgment impugned in the Letters Patent Appeal ceased to exist. The appellant retained liberty to challenge the final order through remedies available in law. The disposal illustrates the practical consequence of a final decision overtaking an interim challenge; it does not adjudicate the wage award or guarantee maintainability or success of any fresh remedy.
