J&K High Court Quashes Matrimonial Prosecution After Verified Settlement

Following a verified matrimonial settlement, the petitioners sought quashing of a charge-sheet under Sections 498-A, 109 and 504 IPC pending before the Chief Judicial Magistrate, Rajouri.

Judge / Bench — Hon’ble Mr. Justice Sanjay Dhar, Judge

The spouses had agreed to resolve their differences and dissolve the marriage by mutual consent; their statements before the Registrar Judicial confirmed the compromise. The Jammu & Kashmir and Ladakh High Court distinguished inherent quashing jurisdiction from statutory compounding and applied the principles governing disputes of a predominantly private or matrimonial character. It held that continuing the prosecution after settlement would defeat the compromise and amount to an abuse of process. The charge-sheet arising from FIR No. 07/2023 and consequential proceedings were quashed. Relief remains dependent on the dispute’s nature and verified settlement.
