Direction To Consider Representation Does Not Override Pending Civil Litigation

A non-party sought review of a threshold order directing revenue authorities to consider another group’s ownership representation, alleging concealed civil litigation and contradictory title claims.

Judge / Bench — Hon’ble Mr. Justice Mohd Yousuf Wani, Judge

The Jammu & Kashmir and Ladakh High Court recognised the apparent concealment but clarified that the earlier order had granted no ownership right or relief prejudicing the review petitioner. Consideration according to law necessarily remained within the authorities’ powers and subject to competent civil-court orders. They must account for the pending litigation and hear the review petitioner when deciding the representation. The review was disposed of with those clarifications. The decision cautions against using a routine consideration order as substantive title recognition or as leverage in contempt to bypass an affected rival and a pending civil dispute.
