Jammu & Kashmir and Ladakh High Court

Mutual-Transfer Reversal Stayed On Prima Facie Notice And Consent Concerns

A Division Bench of the Jammu & Kashmir and Ladakh High Court stayed a Tribunal judgment undoing a mutual transfer and the consequential relieving order, permitting the petitioner to continue at her existing school pending further orders.

Judge / Bench — Hon’ble Mr. Justice Sanjeev Kumar and Hon’ble Mr. Justice MA Chowdhary, Judges

She alleged that the Tribunal had decided the matter without serving her, despite documents indicating mutual consent and no withdrawal before the transfer order. The Bench found those documents prima facie supportive and issued notice. The protection was expressly subject to the other side’s objections and the next hearing; neither valid service nor the final legality of the transfer was conclusively determined. The order is useful for interim-relief applications involving an affected employee’s non-service and an already implemented consensual transfer, with the supporting documents and procedural history central to the request.
