A Division Bench of the Jammu & Kashmir and Ladakh High Court rejected the Government’s attempt to confine Doda migrants’ cash assistance to a later policy or verification date where earlier final judgments had already required parity with Kashmir migrants.
Judge / Bench — Hon’ble Dr. Pushpendra Singh Bhati, Chief Justice, and Hon’ble Mr. Justice Rajesh Sekhri, Judge
The dispute had been pursued through representative litigation since 1996, defeating the contention that these claimants had simply slept on their rights. The Bench retained the merits of the Single Judge’s decision while specifying assistance from August 1999 for respondents 2, 3, 11 and 12, and from 29 November 2005 for the remaining petitioners-respondents. The appeal was disposed of accordingly. For welfare-benefit litigation, the decision requires attention to the binding earlier adjudication, the claimants covered, and the precise commencement dates, rather than treating a later administrative policy as the sole source of entitlement.
