Jammu & Kashmir and Ladakh High Court

Tender-Specific Participation Protected While MES Enlistment Appeal Remains Undecided

The Jammu & Kashmir and Ladakh High Court granted limited interim protection to a contractor awaiting both renewal of MES enlistment and the outcome of an appeal against removal from the approved list.

Judge / Bench — Hon’ble Mr. Justice Rahul Bharti, Judge

The contractor claimed timely applications and compliance with a later information request, yet no appellate decision had followed while tender opportunities were being lost. Pending notice and replies, the Court directed that it be treated as enlisted solely to submit a bid in the specifically identified Khalsar tender. The direction was subject to the respondents’ objections. It did not generally renew enlistment, quash removal, decide the administrative appeal or guarantee acceptance of the bid. For urgent tender relief, the order illustrates a narrowly confined participation measure preserving one opportunity pending adjudication.
