Jammu & Kashmir and Ladakh High Court

Tender Objection Must Be Decided Before Judicial Determination Of Technical Eligibility

The Jammu & Kashmir and Ladakh High Court declined to determine a bidder’s technical eligibility before the Chief Engineer decided its timely objections under the tender procedure.

Judge / Bench — Hon’ble Mr. Justice Shahzad Azeem, Judge

The rejection concerned similar-work experience and uploaded equipment particulars; those matters first required examination within the tender documents by the designated authority. To prevent the pending objection from becoming ineffective through opening of financial bids, the Court required a speaking decision by 18 October 2026 and deferred that opening until disposal. It expressed no view on whether the bidder met the technical conditions. The decision is useful for framing relief that secures the promised administrative objection process without asking the writ court prematurely to substitute its own technical evaluation or award the contract.
