Jammu & Kashmir and Ladakh High Court

Pending Recovery Suit Supports Prima Facie Concern Over Criminalisation Of Civil Liability

The Jammu & Kashmir and Ladakh High Court stayed investigation after finding prima facie that an outstanding-payment dispute already pursued through a civil recovery suit had been given a criminal colour.

Judge / Bench — Hon’ble Mr. Justice Shahzad Azeem, Judge

The petitioners challenged the cheating FIR and referred to the pending suit for the same alleged liability. The Court issued notice and granted the stay subject to the other side’s objections until the next hearing. It did not finally hold that the ingredients of cheating were absent, quash the FIR or decide the debt. For criminal-process challenges arising alongside recovery proceedings, the order illustrates the importance of identifying the factual overlap and pleaded criminal elements; its provisional finding cannot be treated as a rule that any pending civil suit automatically bars investigation.
