J&K High Court Accepts Apology, Recalls Perjury Notice Without Reopening Dismissed Case

A review petition challenged adverse observations and a perjury show-cause notice issued when the underlying petition was dismissed.

Judge / Bench — Hon’ble Mr. Justice Sanjay Dhar, Judge

Through counsel, the affected petitioner tendered an unconditional apology and attributed the affidavit to mistaken legal advice, denying any intention to suppress facts. In that factual setting, the Jammu & Kashmir and Ladakh High Court recalled the notice and dropped the proceedings against him. It also allowed the respondent’s application for release of money deposited in the Registry, directing transfer to the respondent’s bank account because the main petition already stood dismissed. The order illustrates discretionary acceptance of an apology in pending perjury proceedings; it neither reopens the dismissed main case nor establishes a general immunity for false affidavits.
