Bona Fide Review Pursuit Explains Delay; Material Date Error Requires Fresh Consumer Adjudication

A Division Bench of the Jammu & Kashmir and Ladakh High Court condoned 814 days’ delay because the appellant had bona fide pursued correction or review before the Consumer Commission.

Judge / Bench — Hon’ble Mr. Justice Sanjeev Kumar and Hon’ble Mr. Justice MA Chowdhary, Judges

It then set aside the consumer decision after finding an apparent error in treating 3 December 2008 as earlier than 15 January 2008. Although the Bench could not say that this mistake alone caused dismissal, it was a factor that might have influenced the outcome. The complaint was remanded for fresh adjudication, with the parties directed to appear on 23 November 2026. The Bench expressly left the Commission’s review power undecided. Counsel should separate a material apparent chronological error warranting appellate intervention from any broader proposition about the consumer forum’s power to review itself.
