The Union challenged an Armed Forces Tribunal award recognising an eye disease alongside service-attributable pulmonary tuberculosis for disability pension.
Judge / Bench — Hon’ble Mr. Justice Sanjeev Kumar, Judge; Hon’ble Mr. Justice M A Chowdhary, Judge
The Release Medical Board had labelled the eye condition neither attributable to nor aggravated by service, but described its cause as idiopathic. A Division Bench of the Jammu & Kashmir and Ladakh High Court treated that medical uncertainty as doubt to be resolved in the serviceman’s favour, also noting material suggesting a possible connection with tuberculosis. It upheld inclusion of the eye disability and the resulting composite disability of fifty per cent, rounded to seventy-five per cent for life. The writ petition was dismissed. The outcome concerns the particular medical findings; although an Order II Rule 2 objection was recorded, the judgment contains no separate developed ruling on that procedural issue.
