The Supreme Court has granted bail to Amar Singh Rathore, who had spent nearly four years in custody in a Rajasthan fraud case involving allegations of cheating, breach of trust, forgery, conspiracy and an Information Technology Act offence.
The bench noted that the charge sheet and a supplementary charge sheet had been filed, while the prosecution proposed to examine 90 witnesses. With no realistic prospect of an early conclusion, continued detention would be difficult to justify.
Parity was also decisive. Rathore said he was a nominal director comparable to a co-accused whom the court had already released. The order sets aside the Rajasthan High Court’s refusal of bail and leaves conditions to the trial court.
Rathore must provide police with a contact number, surrender any passport and cooperate with the trial. The court stressed that its observations do not address the merits of the prosecution.
