The Jammu and Kashmir and Ladakh High Court has quashed a preventive detention order based on criminal cases arising from personal hostility, holding that private disputes did not threaten public order.
In Mohd Yousuf v Union Territory of Jammu and Kashmir, 2026:JKLHC-JMU:2959, the authorities relied on four police cases to detain the petitioner under the Public Safety Act. The court found that the alleged acts affected identified individuals and remained rooted in personal enmity.
Repeated involvement in similar offences does not by itself convert a law-and-order problem into a public-order threat. Ordinary criminal process was available, and the government had already sought cancellation of the petitioner’s bail. Resorting to preventive detention before that application was decided improperly displaced the regular courts. The detention order was quashed and the petitioner was directed to be released immediately unless held in another case.
