The Allahabad High Court has ruled that a senior citizens tribunal cannot adjudicate a contested allegation that a registered gift deed was forged.
In Balveer Singh v State of Uttar Pradesh, 2026:AHC:193275-DB, a 68-year-old man alleged that his daughter fabricated a deed transferring his only house and then dispossessed him. He sought cancellation and restoration of possession under Section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.
The court said Section 23 provides a summary remedy where a genuine transfer was conditioned on maintenance and the transferee fails to honour that obligation. It does not authorise an administrative tribunal to conduct a full trial on signatures, title and fraud. Those questions require evidence and the procedural safeguards of a civil court. The petition was dismissed, while expressly preserving the man’s right to bring an appropriate civil action.
