The Meghalaya High Court has upheld a man’s conviction for aggravated sexual assault, holding that sexually motivated touching of a child’s breast falls squarely within Section 7 of the POCSO Act even without penetration.
The survivor, aged 15, described being assaulted by her uncle while staying at his home. Although the evidence did not establish penetrative assault, it supported the finding that he touched her breasts with sexual intent. Her account was corroborated by family testimony and the history recorded by the examining doctor.
The Court dismissed the appeal and found no defect in the conviction under Sections 9(n) and 10. It also sought confirmation that the ₹1 lakh compensation recommended for the survivor had been disbursed.
