In a significant legal development, the Supreme Court has overturned a controversial verdict by the Calcutta High Court, which had issued moral advisories to female adolescents regarding their sexual conduct. The case in question, Probhat Purkait v. State of W.B., involved a decision by the High Court that had sparked widespread debate due to its contentious remarks.
The Calcutta High Court, while acquitting a man previously convicted under Sections 363 and 366 of the Indian Penal Code and Section 6 of the POCSO Act, took the opportunity to deliver advice that many found outdated and patronizing. The court had suggested that young women should “control sexual urges” to avoid being perceived as “losers” by society. Additionally, the High Court emphasized the importance of male adolescents respecting the dignity, privacy, and autonomy of women.
However, the Supreme Court, led by Justices Abhay S. Oka and Ujjal Bhuyan, found these remarks to be inappropriate and set aside the High Court’s advisories. The apex court restored the conviction of the accused, reaffirming the importance of protecting the rights and dignity of all individuals, regardless of gender.
This ruling by the Supreme Court not only rectifies the legal standing of the case but also sends a clear message about the importance of upholding modern principles of equality and respect for personal autonomy.
