In a stern reminder that harm isn’t measured only by physical force, a ruling from the Nagpur bench has clarified that even a seemingly small gesture can carry the weight of a serious crime when paired with sexual intent.
The court examined a case involving a man who approached a 13-year-old girl from his neighbourhood, stepping into her home under the guise of asking for water. What followed was an offer of a small amount of money and an invitation wrapped in an ambiguous phrase—an attempt the child didn’t fully grasp at first. When he returned the next day, repeating the offer and gripping her hand, the intent behind the gesture became unmistakable.
Startled, the child pulled away and confided in her uncle, setting the legal process in motion. The complaint that followed led to a trial where the man was convicted and sentenced to three years of rigorous imprisonment.
On appeal, the High Court found no reason to disturb that outcome. The child’s account was clear, steady, and unforced—details that carried significant weight. Arguments suggesting that “mere hand-holding” should not amount to an offence found no traction. The court underscored that the law shielding children from sexual offences is designed to respond not only to completed acts, but also to attempts, inducements, and behaviour infused with sexual intent.
The sentence was left intact, with the court noting that leniency in such circumstances would erode the very purpose of the statute meant to protect children from predatory behaviour.
