The Punjab and Haryana High Court has rejected constitutional challenges to Haryana’s online employee-transfer policy, including its treatment of postings involving spouses.
The policy awards couple-case points where a spouse works in Haryana, Delhi or Chandigarh, but not in Punjab, Rajasthan or Uttar Pradesh. The Court accepted the State’s explanation that Haryana maintains offices and potential postings in Delhi and Chandigarh, creating a rational connection to the benefit that does not exist in the neighbouring states.
It also held that apprehended misuse of “blocked posts” could not invalidate a policy before implementation. Couple-case points must remain available regardless of the employee’s gender. More broadly, the Court said executive transfer policies guide administration but do not create an enforceable right to a preferred posting; intervention remains limited to mala fides, incompetence or clear breach of statutory rules. Both petitions were dismissed.
