The Punjab and Haryana High Court has required Haryana’s Chief Secretary to explain the rules governing reinstatement of public servants accused of corruption, particularly when they return to posts connected with the alleged misconduct.
The Court said such reinstatement can restore access to sensitive records and subordinate staff involved in the case, creating risks of witness influence or record manipulation. It asked whether authorities must consult prosecutors or the trial court before revoking a suspension and how those risks are assessed.
The directions arose during a police officer’s bail petition. The officer received interim regular bail subject to restrictions against tampering, absence from trial, further offending or delaying proceedings, and was ordered to deposit his passport. The affidavit was directed to be filed before the next hearing. The order does not decide the prosecution’s merits; it opens a wider examination of safeguards surrounding sensitive reinstatements.
