The Supreme Court has granted bail to Kaif Mobin in a narcotics case after weighing one year of custody, parity with a released co-accused and the quantity attributed to him.
Customs officers alleged that Mobin carried 5.99 kilograms of cannabis at Kolkata airport, while a co-accused carried a similar amount. Together, the seizure was recorded as 11.975 kilograms. The Calcutta High Court had refused bail.
The Supreme Court found further detention unnecessary while the trial remained pending. Its reasoning reflects an individualised approach: the bench considered the amount allegedly recovered from Mobin, the period already spent in jail and the fact that the co-accused had secured release.
Bail remains subject to conditions imposed by the trial court. Mobin must attend proceedings and cannot influence witnesses. Any unjustified absence or breach may permit cancellation. The bench clarified that the order makes no finding on guilt.
