The Supreme Court has cancelled bail and suspension of sentence granted to Chandan Kumar in a Bihar conviction appeal, directing him to surrender within two weeks.
The Court said his position was materially the same as that of an accused covered by an earlier connected order. His counsel accepted that one of those persons was similarly situated, leaving no reason for a different result.
Once Kumar surrenders, the trial court must take him into judicial custody. He may, however, seek an early hearing of his appeal before the Patna High Court.
The judges stressed that observations concerning interim release must not prejudice determination of the substantive appeal. The order therefore restores custody without deciding whether the conviction should ultimately stand.
