The Supreme Court has granted regular bail to Liton Roy after seven months in custody in a West Bengal prosecution that includes an allegation under Section 64 of the Bharatiya Nyaya Sanhita.
The Court said, on a preliminary view, that the case appeared to involve a relationship that had turned sour. It also recorded that investigators had filed the charge sheet, reducing the need for continued custodial detention.
Roy’s release is subject to conditions set by the trial court. The Supreme Court set aside the Calcutta High Court circuit bench’s refusal of bail without making findings on the truth of the complainant’s account.
The order turns on the stage of the investigation and the duration of custody. It leaves evidentiary questions and criminal responsibility entirely for trial.
