Visa Does Not Guarantee Foreign Nationals Entry

The Delhi High Court has dismissed a Turkmenistan citizen’s challenge to her refusal of entry, holding that a valid visa does not create an absolute right to admission into India.

Justice Amit Mahajan said visa issuance and immigration clearance are distinct sovereign functions. Under the Immigration and Foreigners Act, 2025, officials may examine travel documents and refuse entry on grounds including national security, public order and other statutory considerations.

The court reviewed confidential material and recorded discrepancies in the traveller’s details, uncertainty about her stated business purpose and an unusually frequent travel history. It found that the immigration decision was supported by material and was not arbitrary.

The fact that her husband was admitted on the same flight did not establish unequal treatment because the adverse assessment related specifically to her. Without an enforceable right to enter India, the court concluded that no writ could issue and dismissed the petition.
