The Uttarakhand High Court has quashed the selection of a general-category candidate for an Assistant Professor post reserved for economically weaker sections.
The division bench found that an eligible EWS candidate was available and that the recruitment rules did not prescribe a minimum interview score. Nor had the university recorded that the petitioner was unsuitable.
The court rejected the university’s attempt to justify filling the reserved Statistics post from the general category. It said the selection process could not disregard the reservation merely because the chosen candidate received higher marks.
The university was directed to consider the petitioner for appointment and, if otherwise eligible, issue an appointment letter within three weeks. The judgment was delivered on October 6, 2026.
