Madras High Court Restores Elderly Widow’s Right to Shared Home

The Madras High Court has restored residence and protection directions for a 73-year-old widow while staying an appellate order that had displaced them.

The court said legislation protecting senior citizens cannot be reduced to a monetary arrangement when residence and security are at stake. It directed the district administration and police to ensure Mahalakshmi’s safe re-entry into the shared home, while clarifying that the interim order does not decide title.

Her son must pay ₹15,000 a month, and police must make daily visits and file reports on her safety. The directions remain interim while the criminal revision proceeds, with the next hearing fixed for 29 October 2026. The order was pronounced on 9 October 2026.
