Preventive Detention Materials Must Be Supplied in Known Language

The Kerala High Court has set aside a preventive-detention order because the detainee was not supplied the order and relied-on documents in a language she understood.

Justices Anil K. Narendran and Muralee Krishna S. held that meaningful communication is a constitutional safeguard, not a formality. Providing materials in an unfamiliar language deprived the detainee of an effective opportunity to make a representation against detention.

The court invalidated both the detention order and its confirmation, directing Ayishath Ruksana’s release unless she was required in another case. The judgment, delivered on 9 October 2026, reiterates that every document forming the basis of preventive detention must be made intelligible to the person detained.
