The Supreme Court has rejected a lecturer’s claim to absorption into a grant-in-aid post, holding that service in a no-grant college created no legal entitlement to appointment against a government-funded position.
It also found the writ petition procedurally defective because Maharashtra, the entity bearing the financial liability, had not been impleaded in its juristic capacity. The court reiterated that unequal or unlawful benefits granted elsewhere cannot create a claim to “negative equality”.
Allowing the state’s appeals on 13 October 2026, the bench set aside the direction requiring absorption. However, using Article 142, it ordered Maharashtra to pay lecturer Sudhir ₹10 lakh within eight weeks. Compensation already paid by the college management will remain with him.
