The Madhya Pradesh High Court has directed authorities to ensure treatment, compensation and legal assistance for a sexual-assault survivor while rejecting an accused’s fourth bail application.
Judge / Bench — Justice Gajendra Singh.
The 13 October 2026 order noted that the survivor remained unable to testify and required further treatment. A positive DNA report concerning the applicant supported refusal of bail; the order does not determine guilt.
The Mandsaur District Legal Services Authority must ensure interim compensation, if not already provided or under process, and appoint an experienced advocate. Medical, psychological and counselling support, and transport for testimony, must be arranged.
The Additional Chief Secretary for Medical Education must secure statewide compliance with Section 397 BNSS, including free treatment in public and private hospitals. The court warned that failures could cause secondary victimisation.
Advocates appearing — Applicant — Santosh Kumar Meena. State — Hemant Sharma, appearing on behalf of the Advocate General.
