PSA Order Set Aside Before Execution After Unexplained Delay Broke The Live Link

The Jammu & Kashmir and Ladakh High Court entertained a challenge to a PSA order at the pre-execution stage and set it aside, finding that unexplained delays undermined the claimed need for immediate preventive action.

Judge / Bench — Justice Rajesh Sekhri

Detention was proposed more than a year after the last alleged activity; the authority then delayed making the order, and execution remained unachieved for over four months. Taken together, the chronology severed the live and proximate link between the allegations and the purpose of detention. The judgment recognises limited pre-execution judicial review in appropriate cases, rather than an unrestricted right to bypass detention procedure. For counsel, it makes the dates of alleged activity, sponsorship, order and attempted execution central to the challenge.
