 Rajasthan High Court Initiates Major Reforms Against Food Adulteration

In a pivotal move, the Rajasthan High Court has taken proactive measures against the pervasive issue of food adulteration, raising critical concerns over the effectiveness of existing regulatory frameworks. Highlighting the shortcomings of the Food Safety and Standard Act, 2006, the court underscored the alarming gaps in monitoring and enforcement, particularly in unorganized sectors crucial to food production.

Justice Anoop Kumar Dhand, presiding over the case, lamented the inadequate infrastructure of food testing labs and the understaffed food authorities, which he argued, hindered effective oversight of food manufacturing practices across the state. The court’s suo motu action, driven by a public interest litigation, aims to address the severe health risks posed by adulterated food, emphasizing its detrimental impact on public health.

Asserting constitutional rights to a safe and healthy environment under Article 21, the court urged both the State and Central governments to step up efforts in implementing and strengthening food safety laws. It criticized the Food Safety and Standard Act for neglecting the agricultural and unorganized sectors, key players in the food supply chain.

Furthermore, the court issued a series of interim directives to combat adulteration effectively. These include enhancing monitoring mechanisms, establishing well-equipped testing facilities, and implementing rigorous sampling protocols at various administrative levels. The directives also call for the establishment of committees to oversee compliance and dissemination of information through multiple media platforms.

The court’s directives, scheduled for review on July 30, reflect a concerted effort to mobilize legal and public support against the pervasive issue of food adulteration. Senior advocates and legal experts have been summoned to provide insights and recommendations, underscoring the collaborative approach to tackle this pressing public health concern.

As the legal battle intensifies, the Rajasthan High Court remains steadfast in its commitment to safeguarding public health and ensuring stringent enforcement of food safety regulations across the state.
