Cattle Transport Cases Did Not Justify Preventive Detention

The High Court of Jammu & Kashmir and Ladakh has quashed preventive detention based on criminal cases alleging unlawful cattle transport, finding no material showing communal tension or a public-order disturbance.

In Din Mohd Wani v Union Territory of J&K, decided on 6 October 2026, the Court found that the detention grounds reproduced the police dossier without independent assessment. It also held that the detainee had not been informed of his right to make a representation to the District Magistrate before government approval.

The Court ordered his immediate release unless required in another case. The judgment distinguishes ordinary law-enforcement allegations from the higher threshold required to justify preventive detention under public-order powers.
