Bank-Initiated Lookout Circulars Cannot Survive Completed Investigations

The Delhi High Court has quashed bank-initiated lookout circulars against petitioners whose criminal investigations had concluded and resulted in charge sheets.

Justice Amit Mahajan held that a lookout circular cannot continue routinely merely because a person faces trial. A bank’s financial claim and an unsubstantiated fear that the accused may leave India do not, by themselves, justify an indefinite restraint on travel.

The court left separate circulars issued at the CBI’s request for the trial court to consider and made clear that pending proceedings and lawful travel conditions remain unaffected. It allowed the petitions filed by Sirajuddin Qureshi and others on 7 October 2026.
