RTE Students Cannot Demand Transfer Between Private Schools

The Chhattisgarh High Court has held that children admitted under the Right to Education Act cannot demand automatic transfer from a closed private unaided school to another such institution.

The court said the statutory framework does not create an enforceable right to continue free education in a different private school after closure. It nevertheless directed the state to place the affected students promptly in nearby government schools, with priority for English-medium facilities where available.

Authorities must prevent transfer certificates or missing records from delaying admission. The court disposed of the petition filed by Atharv Gupta and other students on 6 October 2026, while requiring practical arrangements to protect their continued education.
