Delhi High Court Protects Property Share From Auction Amid Mortgage Forgery Dispute

The Delhi High Court has protected Shashi R. Jatia’s one-third undivided property share from auction pending adjudication of disputed loan documents, while leaving enforcement against the remaining shares unrestricted.

Judge / Bench — Justice Jasmeet Singh.

The 13 October 2026 judgment relied on prima facie forensic material and an Economic Offences Wing report concerning allegedly forged signatures. Because the challenge went to the existence of the security interest, the ordinary alternative-remedy rule did not preclude writ intervention.

The court did not finally determine forgery or the validity of the mortgage. Those questions remain for the competent forum; the protection prevents irreversible third-party rights over Jatia’s share meanwhile.

Advocates appearing — For the petitioner — Vaibhav Gaggar, senior advocate, with Abhijeet Chauhan and Mayank Singhal. For respondent 1 — Rajiv Nayar, senior advocate, with Naveen Soni. For respondents 3–4 — Sidhant Kumar, Om Batra and Anwita. For respondent 2 — Not named in the judgment.
